Memorandum of Understanding on Critical Infrastructure Protection

The Administration of the State Service of Special Communications and Information Protection of Ukraine
And
The Department of Public Safety and Emergency Preparedness of Canada Concerning Critical Infrastructure Protection
The Administration of the State Service of Special Communications and Information Protection of Ukraine
and
The Department of Public Safety and Emergency Preparedness of Canada, hereinafter referred to individually as a "Participant" and collectively as the "Participants", intending to establish relations and bilateral cooperation between them in order to combine mutual efforts, as well as technical and human resources in the field of critical infrastructure (CI) protection, have come to the following understanding:
1. Purpose
The purpose of this Memorandum of Understanding (Memorandum) is to establish and define areas of cooperation between the Participants in the field of CI protection.
2. Areas of cooperation
The Participants will cooperate within the framework of this Memorandum in the areas and in the manner set forth below:
- Exchange of experience in CI protection planning: Facilitate the exchange of experience, knowledge and recommendations in the field of protection planning to improve relevant processes (including risk assessment methodologies, threat detection methods and resilience strategies)
- Scientific and methodological cooperation in the field of CI protection planning and resilience enhancement: Assist in the implementation of the CI protection planning system, development of comprehensive and adaptive plans at the national, regional and facility levels
- Joint seminars and trainings: Organize joint seminars and workshops on CI protection planning to share best practices in protecting CI assets
- Support in the development of legislative and regulatory acts: Implementation of the best international practices and requirements, ensuring a comprehensive and coherent approach to CI planning and protection
- Each Participant may refrain from providing the other Participant with information that may directly or indirectly pose a serious risk to the national security of its country
- In any event, the Participants may also work together through cooperation mechanisms other than those listed above, as they deem appropriate and as they jointly decide
- In order to promote the purpose of this Memorandum, the Participants intend to develop work programs consisting of joint activities planned for the relevant period
- The Participants, by joint decision, may invite representatives of other government agencies, as well as the private and educational sectors, research institutes or other organizations whose activities are directly related to the purpose of this Memorandum, to participate in events or programs related to the cooperation under this Memorandum
3. Points of contact
In order to facilitate cooperation under this Memorandum, each Participant will designate a point of contact to be contacted on any aspect of its application.
4. Confidentiality of information
The Participants will keep the confidentiality of information, including information on technological solutions, projects and the content of financial and other programs, which they become aware of in the course of cooperation under this Memorandum.
5. Financial matters
- This Memorandum is not a financial commitment of funds nor a basis for the transfer of funds. Consequently, it is understood that all expenses incurred by the Participants will be subject to their respective budgetary and taxation processes, and the availability of their respective funds, in accordance with applicable law and policies
- Each Participant will bear its own expenses arising from the activities provided for in this Memorandum unless the Participants jointly decide to share costs otherwise
6. Differences of interpretation and application
Any differences concerning the interpretation or application of this Memorandum will be settled by friendly discussions in good faith between representatives appointed for that purpose by the Participants.
7. Amendments
The Participants may amend this Memorandum at any time upon their mutual written consent.
8. Termination
Either Participant may terminate this Memorandum at any time, by giving to the other Participant three months' written notice of the planned date of termination.
9. Legal status
This Memorandum is not legally binding.
10. Coming into effect
This Memorandum will come into effect on the date of signature of both Participants and will remain valid for a period of 5 (five) years after which it will be automatically renewed for the same period, unless either Participant terminates it.
Signed at Ottawa, Ontario, Canada, on the 8th day of December, 2025, and at Kyiv, Ukraine, on the 13th day of January, 2026. In duplicate, each in English, French and Ukrainian languages, each version being equally valid.
